Job summary This role will provide support and collaboration to commissioning teams in Continuing Health Care, Mental Health, Learning Disability, Children and Finance to settle a range of commissioning disputes inter NHS, Intra-NHS, internally between teams and Providers by means of mediating, conciliating or arbitrating in certain circumstances.The post holder will maintain strong relationships between Heads of Services to their area with resolving complex and debatable challenges to avoid legal litigation and unresolved issues.
The post holder will help formulate a response with the allocated investigator, responsible to obtain and collate the evidence/responses.
This will help to ensure the progressive improvement of commissioning outcomes, enhanced productivity, efficiency and best value in models of service delivery.This role will work alone or in collaboration with service leads to help find a way forward on procedural issues.
Main duties of the job Facilitating communication in disputes to establish a mutual agreement, clarifying issues and providing support where required to service leads to collate and present their evidence and other relevant documents to reach a resolution.
This may include support of redesigning of process and can join in conversation for example by recommending rephrasing statements or creating standard responses to solve problems.Push for changes in service lead negotiations for example de-couple issues and "bank" what can be settled.Guiding discussion of issue of content and propose non-technical/clinical solutions that draws on elements of each party's offer or generating a creative solution.

This includes ensuring teams adhere to the standard set out locally with quality and audits of the service;Manage the communications where judicial review/legal challenges have been instigated for example an ICBs decision to reduce a package of care, change provider choice and funding decisions.
This may involve review and drafting of documents submitted to court or to participants required for court orders or applications such as Court of Protection Hearings.Ensuring member engagement is retained and enhanced through the locality teams, working closely with the clinical leads for the area.Working as part of a network of Deputy Directors/Heads of Service posts across the SWL ICB, to support and enable commissioning resolution and transformation of processes.
Ensuring teams understand how to interpret and apply ICS responsible commissioner guidance as set out by NHS England including where they can receive further guidance from NHS England.
Oversee and co-ordinate all complaint responses across the SWL wide All Age Continuing Care teams.
Over see and co-ordinate all Subject Access requests and Freedom of Information requests across the SWL wide All Age Continuing Care teams, liaising with Deputy Directors of place based teams, the Performance Manager and Finance Managers to collate information and ensure it is appropriately gathered to meet the standard.
Person Specification Education / Qualifications Essential Educated to masters level or equivalent level of experience of working at a senior level in specialist area.
Extensive knowledge of specialist areas, acquired through post graduate diploma or equivalent experience or training plus further specialist knowledge or experience to master's level equivalent Evidence of continued professional development Member of relevant professional body Knowledge and Experience Essential Must be able to provide and receive highly complex, sensitive or contentious information, negotiate with senior stakeholders on difficult and controversial issues, and present complex and sensitive information to large and influential groups Significant experience of successfully operating in a politically sensitive environment Problem solving skills and ability to respond to sudden unexpected demands Previously responsible for a budget, involved in budget setting and working knowledge of financial processes Demonstrated experience in a Healthcare environment Experience of setting up and implementing internal processes and procedures.
